Over 100 people in the last decade have been wrongfully accused of a crime they didn’t commit either due to lack of evidence or witnesses! Imagine if you have been wrongful accused of doing something you know you didn’t and all the fingers are pointing at you say your guilty…….you spend 5 years in jail and are the told to register legally as a sex offender……..kinda sucks right!!! Am sure those words are an understatement to describe how Brain Brooks felt when he was convicted in 2002. However last week, on the 24th of May he was exonerated after Wanetta Gibson admitted she lied about the kidnapping and rape.
In 2002, Banks was a 17-year-old senior at Long Beach Polytechnic High School with a promising future probably in the NFL. He was a stand out linebacker and his amazing talent would no doubt have gotten him a scholarship in to any university of his choice.
He settled for the University of Southern California on a full scholarship. Unfortunately for him, his hopes of being successful was cut short in July of 2002 when Wanetta Gibson, 15, claimed to have been dragged across campus and raped by him. With no DNA and No witnesses to a crime which she stated happened in broad daylight, it’s a wonder how Banks still got convicted. He pleaded no contest.
As if it’s not enough that an innocent man was sent to prison for absolute nothing, Gibson sat back in her lie and watched her family successfully sue her school district for failing to protect their daughter. The school paid the family $1.5million for damages.
Fast-forward 10years and Gibson caught in her own guilt agrees to speak with a private investigator where she then admitted to fabricating the tale. To think that if Banks didn’t accept the plea deal, if found guilty, he would have face up to 40 years in prison.
During an initial meeting with him, she said she had lied; there had been no kidnap and no rape and she offered to help him clear his record, court records state.
Her reason, “During a brief encounter with Gibson, he said something obnoxious which got her upset and decided to create her own reality, called it a rape, and it the whole lie just snowballed from there.”
However, Gibson refused to repeat that she lied about the whole story to prosecutors because she feared she would have to return payout from the civil suit. During a second meeting that was secretly videotaped, she told Banks, “`I will go through with helping you, but it’s like at the same time all that money they gave us, I mean gave me, I don’t want to have to pay it back,'” according to Freddie Parish, a defence investigator who was at the meeting. Thank God the information she stated, it was that enough evidence to have him exonerated.
He said he still hopes to play professional football.
What would I do if it were you?? would you forgive and forget??? and try to start life over???
